what do we do with tenants that do not want me to show my listing?
Andy
32:39

Tammy Reyes
32:41
I have a question on forms
Irma Sanchez
33:09
what do you do with a tenant that plumbing is connected to the 2nd unit and they are hording and not keeping the home clean affecting the 2nd tenant?
Edward Barrios
33:35
That’s coming from Andy’s Termite?
Andy
33:51
Yes Edward
Andy
34:25
The disclosure came from a realtor
Edward Barrios
34:26
It’s probably the PEAD form.
Andy
34:28
they asked us to sign it
Cody Bellmeyer
34:33
Andy, is it the PEAD form?
Andy
34:38
they said it came from C.A.R.
Lauren Yoon
34:48
If the house is vacant, can I have the house open prior people come in and have them view inside? As long as I keep myself in distance?
Andy
35:12
It says Coronavirus property entry advisoty and declaration
Tammy Reyes
35:59
do I have to send the NTAP form to everyone in residential
Andy
36:06
Yes Edward I think that is it. We are just curious if we have to sign
Virginia Butler
38:35
can we require buyers to sign the PEAD before we allow them to go in the property? thx
Cody Bellmeyer
38:43
@Andy It sounds like the PEAD form. As John said, you want to be cautious when signing any of these forms on the spot. Just be aware that the REALTOR or the seller may not permit you in the property in the event that you refuse to sign the PEAD
Andy
40:00
Cody it seems there is nothing that can harm us by signing as it has nothing to do with our work
Cody Bellmeyer
40:25
Virgina, best practice is to require buyer or anyone else entering into the property to sign the PEAD prior to entering the property. In fact, we recommend denying entry to the extent possible if they refuse to sign the PEAD.
JEFFREY GINSBURG

How can we show a unit that gave notice to move but is still occupied? Our lease agreement allows us to show it with 24hr advanced notice but with COVID-19 of course that's affecting things...can we show it if everybody is wearing masks/gloves?
Tammy Reyes
43:25
would you use the form PEAD in the situation on emergency or health and safe repairs
David Schwartz
44:11
At what point during a transaction should the CVA doc be used if at all?
David Schwartz
49:45
if a buyer or other party refuses to sign a PEAD does that fall under any kind of discrimination?
Tammy Reyes
49:51
are there AIR COVID forms that are better suited for commercial tenants?
Edward Barrios

What is the legal meaning for a "showing"? If no one is inside with the buyers, all safe CAR recommended practices are observed, and the agent is never inside with client, could that technically be called an "inspection"?
Tammy Reyes
53:18
please get the article on contract defense to share
Tammy Reyes
55:07
I don’t see the AIR Corona virus form with that name
MARC ZAREMBA
01:01:34
Why would you want the tenant to stay? Let them out, especially with the situation at hand. or Work out a deal...
Karen Wickline

COVID Stimulus Package• Is the COVID Stimulus Package part of CARES?MLS – Rule 8.0• What is the potential of lawsuits from clients, if they cannot market their house the way they would like to due to the Rule 8.0?INSURANCE | E&O• How do you see E&O carriers adjusting to the COVID-19 situation? Do you foresee an increase in transaction-related claims as a result of this situation? If so, what type of claims do you anticipate (i.e. disclosure, negligence, illegal activity, etc)?

If it were me regarding insurance as an agent, I would pro actively call your insurance Broker to confirm what your e & o actually does cover today. Have them also help you check the work! Purchase more insurance where you feel necessary from there if at all. maybe consult legal between that.

If a tenant cannot pay for April, is it OK to send a notice telling them it’s past due, and we’re not moving to evict them but expect payment at an appropriate time after the lockdown is lifted? The idea is to ensure that they understand the rent is still due and needs to be paid eventually.
